What DAC7 actually requires
DAC7 isn’t a new tax: it’s a reporting obligation placed on digital platforms (second-hand marketplaces, holiday rental sites, platforms for services between individuals…). Above certain thresholds of transactions or amounts, the platform has to report to the tax agency the details of its sellers/hosts and what they’ve earned through it. The tax office receiving this information doesn’t by itself change what you owe — but it does make it much harder for undeclared income to go unnoticed.
What actually matters: occasional sale or economic activity
The tax treatment doesn’t depend on which platform you use, but on the nature of what you’re doing:
- Occasionally selling used personal items (clothes, furniture, electronics you no longer use) usually doesn’t trigger taxation if you sell them for the same price or less than you paid for them — there’s no capital gain because there’s been no real gain. If you sell them for more than they cost, that can create a taxable capital gain.
- Selling on a regular basis for profit (buying to resell, producing to sell, offering accommodation on a recurring, organised basis) is a different matter: that’s an economic activity, with the obligations you already know — registering the activity, declaring income and expenses, VAT where it applies.
The holiday rental case (Airbnb-type)
Renting out a property occasionally can be taxed as income from real estate capital under personal income tax; if you also provide hotel-type services (cleaning during the stay, reception, changing bed linen at hotel-like frequency…) it can come to be treated as an economic activity, with different tax treatment. The line between the two depends on the specific services you offer, not just on which platform you use.
What to do if you’ve received a notice, or just want peace of mind
If you sell or rent fairly often through these platforms and aren’t sure whether your activity should be declared, it’s better to check now than to have the tax agency ask you based on the data it’s already receiving from the platform. Write to us at contacto@asesoriamadal.es and we’ll look at your specific case.
